Terms & Conditions
- Contract: The client's approval for work to commence
shall be deemed a contractual agreement between
the client and mservers. Important: Approval
for the work to commence and payment of the
advance fee indicates that the client accepts
these Terms and Conditions.
- Material: All material supplied by the client shall
remain the client's property. It
will be
assumed that this material belongs
to the
client and that it does not breach
any copyright
laws.
- Domain Name Registration: A list of domains that can be registered
on behalf of the client can be seen here. All .co.uk domains are registered for a
minimum of 2yrs. Other domains can be registered
for a period of 1 to 10yrs. Discounts are
available for longer registrations. Please
contact us for a quote.
- Domain Name Transfers: No charge is made for a transfer of a domain
name TO mservers administration.
Upon domain
transfer, one year will be added
to the expiration
date of the domain and the client
charged
appropriately. Current pricing for
each domain
can be viewed here. Upon transfer completion, your domain's
expiration date will have increased
by one
year.
To transfer a domain AWAY from mservers,
there is a one-off admin fee of £25
per domain name.
- Hosting Service: We prohibit any adult (pornographic) websites
on our servers, including sites linking
to
pornographic sites (outside links)
or pornographic
advertisements on your site.
mservers servers may not be used
for illegal
purposes, or in support of illegal
activities.
Use of mservers service to transmit
any material
(by email, uploading, posting, hot
linking,
directly linking or otherwise) that
infringes
any copyright, trademark, patent,
trade secret
or other proprietary rights of any
third
party, including, but not limited
to, the
unauthorized copying of copyrighted
material,
the digitization and distribution
of photographs
from magazines, books, or other copyrighted
sources, and the unauthorized transmittal
of copyrighted software, is forbidden.
Intentional distributions of software
that
attempts to and/or causes damage,
harassment,
or annoyance to persons, data, and/or
computer
systems are prohibited. Such an offense
will
result in the immediate termination
of the
offending account.
Spamming (sending unsolicited commercial
or bulk emails) using our servers
is strictly
not allowed. Do not send spam email
from
our servers. Sending spam emails
which include
links to a website hosted on one
of our servers
is also forbidden. We reserve the
right to
suspend or terminate any site that
is linked
to spam emails.
- Hosting Payment: The hosting fee is payable 12 monthly and
due 30 days before renewal. The client
understands
that late payment may result in the
site
being taken off the server until
payment
is received.
- Updates/Changes to Website: Before a site goes live, the owner of the
site is responsible for the accuracy of the
site's content, grammar and punctuation.
Once the site is live, any further changes
will incur an update fee. To request an update
or change to the content of your existing
site, updates or changes should be emailed
in the format outlined in the How to Update my Site file. This is to ensure updates are carried
out accurately and promptly. Minor updates
to existing text are charged at a rate of
£30 per hour with a minimum charge
of £5. This pricing is for existing
Customers whose site is hosted with mservers.
Payment is due in advance. Larger updates/additions
will be quoted for on a case by case basis.
Urgent updates will be carried out where
possible ASAP but please allow an average
of 1-3 weeks for completion. If you have
a page(s) which need updating on a regular
basis, it may be worth asking for a quote
for a CMS (Content Management System) which
will allow the Customer to update the page
content him/herself.
- Copyright: mservers retains the copyright of any material,
including the source code, created
for the
client by mservers until payment
of the final
invoice. At this time, it will then
become
the property of the client.
- Search Engine Submission: mservers is not responsible for the client's
ongoing website promotion. Should
the client
require the site to be promoted,
a separate
contract must be agreed. mservers
can make
no guarantees about the success of
any search
engine promotion activity as this
is controlled
by the search engines. All mservers
sites
are built to World Wide Web Consortium
Standards.
- Cancellation: Should the client wish to cancel at any
point during the process, they shall
remain
liable for the work that has taken
place
and shall be invoiced accordingly.
- Quotations: The price quoted to the client is for the
work agreed on the quotation only. Should
the client decide that changes are required,
as the site is developed, the cost of any
additional work will be added to the price
quoted and this will appear on the final
invoice.
- Advance Payment: An advance of 50% of the total cost of
the project is required before work can commence.
After work commences this is non-refundable.
Projects under £200 require full payment
in advance.
- Payment terms: Payment is currently accepted by cheque
or direct online bank transfer. If
your cheque
is returned by the bank as unpaid
for any
reason, you will be liable for a
"returned
cheque" charge of £25.
- Payment: Payment is due within 30 days of the final
invoice. Full publication of the
website
may take place ONLY after full payment
has
been received.
Overdue accounts will incur a late payment
fee of 10% of the amount outstanding.
Any
material previously published may
be removed
if payment is not received. When
this occurs,
a minimum charge of £50 will
be required
to have the site restored.
Notes
Should mservers waive any of these terms
on an individual basis, this shall not affect
the validity of remaining clauses or commit
mservers to waive the same clause on any
other occasion.
By agreeing to these terms and conditions
your statutory rights are not affected.
mservers reserves the right to change or
modify any of these terms or conditions at
any time. Should clarification of any of
